Abstract

Background. Article 17 of the Constitution of the Russian Federation establishes the general rule that the fundamental human rights and freedoms are inalienable and belong to everyone from birth. Thus, the Basic Law constitutes the legal moment of origin of the citizen’s rights. However, the question of the legal moment of termination of rights remains open. The aim of the work is to determine the main characteristics of citizen’s legal personality termination in the context of the right to die, as well as to analyze decisions of the European Court of Human Rights in the said field.
Materials and methods. The research tasks were implemented through analyzing the existing regulations that define the origin and termination of legal personality. For these purposes the author used the method of legal regulation analysis, formal legal and comparative legal methods.
Results. The researcher has pointed out legal personality termination features in the Russian Federation, as well as analyzed some decisions of the European Court of Human Rights in relation to the research topic. Conclusions. The article emphasizes that the methods of civil-legal regulation in relation to determining legal personality do not apply in some cases.
